1. Acceptance of Terms

Services described on our website are general representations and may vary based on site conditions, material availability, and other factors.

3. Estimates and Pricing

All prices are provided as written estimates and are valid for 30 days from the date of issue unless otherwise specified. Estimates are based on the site conditions observed at the time of assessment. If conditions differ materially from what was assessed - due to hidden base failures, subsurface drainage issues, or other factors not visible during the estimate visit - San Angelo Asphalt Paving reserves the right to revise the price before proceeding with work. We will notify you of any revisions before beginning additional work.

Estimates do not include permit fees, utility locating fees, or other government-imposed costs unless explicitly stated. We will inform you of any such costs as early as possible in the process.

4. Scheduling and Cancellation

Project scheduling is subject to weather conditions, material availability, and crew scheduling.San Angelo Asphalt Paving will make reasonable efforts to complete projects within the agreed timeframe but cannot guarantee specific start or completion dates. Weather delays, equipment issues, and other factors outside our control may affect scheduling.

If you need to cancel or reschedule a confirmed project, please notify us at least 48 hours in advance. Cancellations made after materials have been ordered or work has begun may be subject to a cancellation fee to cover material and mobilization costs already incurred.

San Angelo Asphalt Paving reserves the right to cancel or reschedule a project due to weather, unsafe site conditions, or other factors outside our control. In such cases, we will contact you as soon as possible and work with you to find an alternative date.

5. Payment Terms

Payment terms are stated in your written estimate or contract. Unless otherwise agreed in writing, payment is due upon completion of the work. For larger projects, San Angelo Asphalt Paving may require a deposit before work begins, with the balance due upon completion. The deposit amount will be stated in your written estimate.

Accepted payment methods are stated on your estimate. If payment is not received within the agreed timeframe, San Angelo Asphalt Paving reserves the right to charge a late fee and to pursue collection through appropriate legal channels. The customer is responsible for any collection costs, including reasonable attorney fees, incurred as a result of non-payment.

All prices are in U.S. dollars. Prices are subject to change for new estimates but will not change on a signed, accepted estimate within the validity period.

6. Customer Responsibilities

You agree to:

• Provide accurate information about your property and project requirements
• Ensure clear access to the work area on the scheduled project date
• Remove vehicles, personal property, and obstructions from the work area before the crew arrives
• Mark or identify any underground utilities, irrigation lines, or other buried items that could be affected by excavation or grading work
• Obtain any required permits unless we have explicitly agreed to handle permitting as part of the project scope
• Follow all post-service care instructions provided by San Angelo Asphalt Paving, including curing and traffic restrictions

San Angelo Asphalt Paving is not responsible for damage to unmarked underground utilities, irrigation lines, or other buried items.

7. Warranty Disclaimers

Any workmanship warranty offered by San Angelo Asphalt Paving will be stated explicitly in the written estimate or contract for your specific project. Unless otherwise stated in writing, no warranty is implied.

Warranties, where provided, do not cover damage caused by:

• Failure to follow post-service care instructions
• Damage from vehicles or equipment exceeding the design load of the surface
• Acts of nature, including flooding, freeze-thaw cycles, or soil movement beyond normal conditions for the area
• Damage caused by third parties
• Pre-existing conditions that were disclosed or discoverable at the time of the estimate

The website and all information on it are provided "as is" without warranty of any kind, express or implied. San Angelo Asphalt Paving does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

To the fullest extent permitted by applicable law, San Angelo Asphalt Paving will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to our services will not exceed the amount you paid us for the specific project giving rise to the claim.

If direct resolution is not possible, disputes arising out of or relating to these terms or our services will be resolved through binding arbitration in San Angelo, Texas, under the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action lawsuit. Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.

These Terms and Conditions are governed by and construed in accordance with the laws of the State ofTexas, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration will be brought in the state or federal courts located in Tom Green County,Texas.
